Waitigo Privacy Policy

Waitigo LLC ("Waitigo," "we" or "us") operates a U.S.-only point-of-sale and online ordering platform. We are committed to protecting the personal data of our customers and complying with applicable U.S. privacy laws (including the California Consumer Privacy Act, as amended by the CCPA and CPRA). "Personal Information" means any data that identifies or can be linked to an individual. We collect, use, share, and retain personal information only as described below.

Definitions

  • Personal Information (Personal Data): Any information that identifies or can reasonably be associated with an individual (e.g. name, address, email).
  • Services: Waitigo's POS and online ordering systems, including mobile or web applications.
  • Consumer: Any customer or end-user who provides personal information through our Services.

Information We Collect

Waitigo collects the following categories of personal information when you use our POS or online ordering services:

  • Identifiers: Contact details such as full name, email address, phone number, and billing or delivery address.
  • Financial Information: Payment details, such as credit/debit card numbers and billing account information, provided to complete transactions.
  • Transactional Data: Details of your orders or purchases (items, amounts, date/time, etc.) and receipts associated with those transactions.
  • Communications Data: Any messages, emails, or feedback you send to us or that are sent to you (for example, order confirmations and customer service communications).
  • Device/Log Data: Technical information collected automatically, such as IP address, browser or device type, and usage data (to maintain security and site functionality). (We currently do not use cookies or third-party tracking; see below.)

We do not knowingly collect sensitive personal information (such as health, biometric or government ID data) from our customers. In limited cases, we may collect information like age or dietary preferences if you voluntarily provide it for reservation or ordering features.

How We Use Personal Information

We use personal information primarily to provide and improve our Services. For example:

  • Service Fulfillment: We use your data to operate our platform and complete transactions. This includes processing your orders and payments, managing order histories, and providing any associated order confirmations or receipts.
  • Communications: We use contact information to send you transactional messages related to your use of the Services (e.g. digital receipts, shipping or pick-up notifications, and customer support responses). If you opt in to marketing, we may send you promotional communications about our Services; you can unsubscribe or opt out of marketing at any time (see Your Privacy Choices below).
  • Business Operations: We use collected information for internal purposes such as verifying accounts, preventing fraud, analyzing service usage, improving our website and Services, maintaining security, and complying with legal obligations. This may include internal analytics or demographic analysis, but any such use will not include selling or sharing your personal profile with advertisers.
  • Legal Compliance: We use and retain data as necessary to comply with laws and regulations (for example, tax or financial recordkeeping requirements) or to respond to lawful requests by public authorities.

In all cases, we limit use of your personal data to the purposes described above, or purposes for which we have obtained your consent.

How We Share and Disclose Information

We do not sell your personal information to third parties. We share your data only with trusted parties that need it to provide our Services or as required by law:

  • Service Providers: We share information with third-party vendors who perform services on our behalf. This includes payment processors, banks and card networks (financial partners), hosting and IT service providers, email/notification services, fraud detection and identity verification companies, and other technical or marketing partners necessary to operate our Services. Any such vendors are contractually limited to using your data only to the extent needed for their service.
  • Analytics and Advertising: While Waitigo currently does not use behavioral advertising, if we ever implement analytics or ads, we will work with providers (e.g. Google Analytics or ad networks) to improve our Services. In such a case, we will provide notice and opt-out options as required by law. We will implement similar opt-out mechanisms if needed.
  • Legal and Regulatory: We may disclose personal information to comply with laws or legal requests, to protect our rights or property, or to protect the safety of our users or the public. This includes responding to subpoenas, court orders, or government investigations.
  • Business Transfers: If Waitigo is involved in a merger, acquisition, or sale of assets, user data may be transferred to the acquiring entity.

Except as described above, we will not share your personal data without your permission. We also may disclose aggregated or de-identified data for any purpose.

Data Retention

We retain personal information only as long as necessary to fulfill the purposes for which it was collected or to comply with legal obligations. In general, we consider factors such as the sensitivity of the data, our need to complete transactions or support our Services, and any retention period required by law. For example, payment information might be retained to comply with financial regulations or to honor returns/refunds, then securely deleted. When data is no longer needed, we delete or de-identify it.

Your Privacy Rights

Waitigo respects the rights you have under U.S. privacy laws. Under the California Consumer Privacy Act (CCPA/CPRA), California residents have rights to know, access, correct, delete their personal information, to limit its use, and to opt out of its sale or sharing. Similar rights may be available under other state laws (e.g. Virginia's CDPA, Colorado's CPA, etc.). In particular:

  • Access/Know: You can request a copy of the personal information we hold about you, and information about how we have used or shared it.
  • Deletion: You can request deletion of your personal information from our systems (subject to legal exceptions).
  • Correction: You can ask us to correct or update inaccurate information.
  • Opt-Out of Sale/Sharing: Although Waitigo does not sell personal data, if we ever engage in activities covered by CCPA's definition of "sale" or "sharing," you may opt out. For California residents, we provide a "Do Not Sell or Share My Personal Information" mechanism.
  • Limiting Use of Sensitive Data: If we collect any sensitive data in the future, you can request limits on its use or disclosure.
  • Non-Discrimination: We will not discriminate or penalize you for exercising your privacy rights (for example, we will not deny service, charge higher fees, or change terms adversely).

For California residents, we will comply with CCPA verification procedures. You may also designate an authorized agent to make requests on your behalf. We will respond to verified requests within the timeframes required by applicable law. (Note: We may decline requests when legally permitted, such as to protect the rights of others or complete a transaction.)

Cookies and Tracking Technologies

Current Practice: Waitigo does not use cookies, web beacons, or similar tracking technologies on our website or apps at this time. We do not collect location data from your device.

Future Use: If we decide to use cookies, analytics tools, or online advertising, we will update this policy and give you notice. For example, California law requires websites to notify users before placing cookies and to respect opt-out requests. We would implement compliant mechanisms (such as a notice banner and a "Do Not Sell/Share" link) so that you can control any cookie-based tracking. You will always have the ability to control or disable cookies via your browser settings.

For more about cookies: Websites subject to U.S. law (like the CCPA) generally do not require opt-in consent for cookies, but they must inform you of cookie use and allow you to opt out of data "sales." We will follow these requirements and best practices at all times.

Security Measures

We implement reasonable administrative, technical, and physical safeguards to protect your personal information from unauthorized access, use, or disclosure. For example, our website uses industry-standard encryption to secure data in transit, and we restrict access to your data within our company on a need-to-know basis. For payment information, we rely on PCI DSS–compliant payment processors and encryption. However, no security system is infallible. We cannot guarantee absolute security of the information provided to us. If a data breach occurs, we will follow applicable breach-notification laws to inform affected users.

Children's Privacy

Our Services are intended for users aged 13 and over. We do not knowingly collect personal information from children under 13. If we learn we have inadvertently collected data from a child under 13, we will promptly delete that data. If you are a parent or guardian and believe your child has provided us with personal information, please contact us to have it removed.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time (for example, to reflect changes in our business or legal requirements). When we make changes, we will revise the Effective Date above and post the updated policy on our website. We encourage you to review this page periodically for any updates. We may amend this notice by posting a new version on our site with appropriate notice.
